TERMS AND CONDITIONS
This page, together with any documents or correspondence referred to in it, tells you the terms and conditions (“Terms and Conditions”) according to which we supply any of the products (“Products”) and workshops (“Workshops”) shown on www.bainsandwood.com. By ordering from us, you agree to be bound by these Terms and Conditions.
1.Bains and Wood
Bainsandwood.com is operated by Bains and Wood Limited. Bains and Wood Limited is a company registered in England and Wales with Company Number 10161124 and its registered office is at Landgate Chambers, Rye, East Sussex Tn13 7LJ. Bains and Wood trades at Curls Farm, Ripe East Sussex BN8 6AP.
All intellectual property concerning Bains and Wood, including but not limited to this website, it’s design, any images and text are owned by Bains and Wood Limited. No content may be reproduced, copied, used or sold without our prior written consent.
All orders placed with us must be paid for via PayPal. After placing an online order with us, you will receive an email confirmation from PayPal and an email from us requesting further information regarding the relevant Workshop or delivery of the Products you have ordered. Ownership of the Products ordered will only pass to you once payment has been received into our PayPal account.
Our charges for delivery are as shown at the checkout page on our website or as agreed between us via email.
We will send out the Products ordered by you in line with the delivery address and procedure agreed via email. Please be sure to give us a contact telephone number and details of a safe place to leave the Products if you are not going to be able to receive them in person. Delivery is deemed to have been effected when the Products have been left at the delivery address and location specified by you at which point risk passes to you.
We do not accept any liability for delayed deliveries caused by any third party, fire, flood, or mechanical breakdown, traffic congestion, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.
We will always use our best endeavours to ensure that the Products that you receive are as depicted on this website. However, all orders are subject to seasonable availability and we reserve the right to substitute alternative products of equivalent value and of a similar nature where the Products ordered are not available to us. Please note that some flowers may be delivered in bud to ensure longer life.
6.Refunds, Cancellations & Liability
Because of their perishable nature, flowers are not returnable.
We will use our best endeavours to deliver Products to you in perfect condition. In the unlikely event you are not satisfied with the Products you receive, please contact us immediately on receipt. Provided you have presented a valid claim, we will then offer you replacement Products (to the extent that they are available, and if not of an equivalent value) or a refund.
The total liability of Bains and Wood Limited shall not exceed the price of Products supplied by us to you.
If we are going to be unable to provide a Workshop for which payment has been made, we will give you as much notice as possible and whilst no compensation can be given, you will be offered the option of re-booking on another Workshop of equivalent value or a full refund.
If you are going to be unable to attend a Workshop for which payment has been made, we regret that not refund can be given. However we are happy for you to propose a friend or family member to attend in your place, provided you give us the name, dietary requirements and contact telephone number of that person 24 hours in advance of the Workshop.
Alternatively, provided you have given us 2 weeks’ notice of cancellation, you will be entitled to transfer to another Workshop of equivalent value.
These Terms and Conditions do not affect your statutory rights as a consumer.
We reserve the right to vary these Terms and Conditions from time to time.
9.Contracts (Rights of Third Parties) Act 1999
A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.
These Terms and Conditions and any contract formed through this website are governed by English law and any dispute arising shall be subject to the jurisdiction of the courts of England and Wales.
